Lindy and Friends, provides services on the Internet and the World Wide Web (the ‘Web’) through its application and various web sites (collectively, ‘Services‘) owned and operated by Lindy and Friends, LLC (“We” , “us” or “our” or Lindy and Friends) knows you care how information about you is used and shared. We hope the following statements will help you understand how Lindy and Friends will collect, use and protect the information you provide to us on our site or app.

What we collect and how we use it

  • Children. Protecting the privacy of children is extremely important to us.  We do not knowingly collect data from children under the age of 13.  If you are under the age of 13, please do not submit any personally identifiable data through the Services.  We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide personally identifiable data through the Services without parental consent.  If you have reason to believe that a child under the age of 13 has provided personally identifiable data to us through the Services, please contact us, and we will endeavor to delete that information from our databases.
  • Information you provide. When you sign up for a Lindy and Friends account or some other account or promotion that requires registration, we ask you for personal information (such as your name, email address and an account password). We may combine the information you submit under your account, with information from our Services or third parties to provide you with a better experience and to improve the quality of our services. For certain Services, we may allow you to opt out of combining such information.
  • Unique Device ID and GPS location. When you access the Services, we may collect your Unique Device ID (‘UDID’) and/or IP address, Personal Identifiable Information (PII) and/or GPS location. We use this information to provide a tailored experience for you. The information is collected in order to determine the aggregate number of unique devices using our service or parts of our service, to track total usage, analyze data, and communicate with you more effectively. We may combine this information with information from third parties to provide you with a better experience and to improve the quality of our service. We do not share any personally identifiable information with third parties in association with your UDID or GPS location without your explicit permission.
  • Cookies. When you use our Services, we may send one or more cookies to your computer, so that we may uniquely identify your browser. (A cookie is simply a tiny text file containing a string of characters.) Accepting our cookies allows you to keep your user preferences from session to session. Some Lindy and Friends Services may not function properly if you have cookies disabled.
  • Log information. When you use Lindy and Friends, our servers automatically record information that your browser sends when you visit one of our websites. These server logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request, and one or more cookies that may uniquely identify your browser.
  • User communications. Personal information or requests that you submit via our Services, we may retain those communications to process your inquiries, respond to your requests and improve our services.
  • Third party sites This Privacy Policy applies only to sites and apps that are owned and operated by us. We cannot regulate other sites linked from within our various web sites and services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you. You should familiarize yourself with their unique Privacy Policies, should you choose to visit their sites.
  • Opt-Out: You can “Opt-Out” of receiving emails for specific events from vendors using our Services by clicking the “unsubscribe” link within any email you receive from us. Essentially, if you want to Opt-Out of all communications, you may have to elect to unsubscribe from multiple emails before you stop receiving all communications.

How do we use your information? When you sign up for a particular service that requires registration, we ask you to provide personal information. If we would like to use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use. You may decline to submit personal information to any of our services, in which case we may not be able to provide those services to you.

How do we protect your information? We do not share your personal information with other institutions without your explicit consent. We may share your personal information only if it has a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms Of Use, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of Lindy and Friends, its users or the public as required or permitted by law. Lindy and Friends takes appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. including internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. Unless explicit permission is obtained from you, we restrict access to personal information to its employees, contractors and agents who need to know that information to operate, develop or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Data Integrity. We review our data collection, storage and processing practices to ensure that we only collect, store and process the personal information needed to provide or improve our Services. We take reasonable steps to ensure that the personal information we process is accurate, complete, and current, but we depend on our users to update or correct their personal information whenever necessary.

Accessing and updating personal information. When you use any Service, we make good faith efforts to provide you with access to your personal information and either to correct this data if it is inaccurate or to delete such data at your request if it is not otherwise required to be retained by law or for legitimate service purposes. When we receive formal written complaints regarding privacy issues, it is our policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between us and an individual.

International Privacy Laws. If you are using our Services from outside the United States, please be aware that you are sending information (including personal data) to the United States where our servers are located. We will hold and process your personal data in accordance with privacy laws in the United States and this Privacy Policy.  Please note that privacy laws in the United States may not be the same as, and in some cases may be less protective than, the privacy laws in your country.

Changes to the Privacy Policy. The Services may change from time to time. As a result (and for other business and/or technological reasons), it may be necessary for us to make changes to this Privacy Policy from time to time.  We reserve the right to update or modify this Privacy Policy at any time and from time to time without prior notice.  Please review this policy periodically, and especially before you provide any personal data. This Privacy Policy was last updated on the date indicated above. Your continued use of the Services after any changes or revisions to this Privacy Policy shall indicate your agreement with the terms of such revised Privacy Policy.

Mode and place of processing the Data
Methods of processing
The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.
The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The Data is processed at the Owner’s operating offices and in any other places where the parties involved in the processing are located.

Retention time
Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.
Therefore:
* Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
* Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.
The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time without providing any justification. How to exercise these rights
